Terms governing use of AI-IT INC websites, services, and the Affiliate-it Platform.

1. Acceptance of Terms

By accessing and using websites, software, hosting, widgets, or the Affiliate-it Platform operated by AI-IT INC (“we,” “us,” or “our”) (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. Creating an account, submitting a project inquiry, embedding widgets, or otherwise using the Service constitutes acceptance.

2. Description of Service

AI-IT INC provides technology services that may include:

  • Custom AI development, software, websites, web applications, automation, and managed hosting
  • AI video and creative production services
  • Affiliate-it Platform features such as business websites, BI/content tools, analytics, lead management, bio links, QR codes, social integrations, VIP affiliate tools, multi-business management, marketplace integrations, and subscriptions
  • AI widgets (order, Q&A, scheduling, and related embeds) for customer sites and demos on ai-itinc.com

AI models: Platform-included models may be evaluated before approval. If you supply your own API key, local endpoint, or custom model ID, you are solely responsible for that model’s safety, quality, legality, and provider terms. AI-IT INC is not liable for harmful, inaccurate, jailbroken, or non-compliant outputs from customer-chosen models or keys.

Custom project scope, pricing, timelines, deliverables, and support for client engagements are defined in separate written agreements.

3. User responsibilities

3.1 Account security

  • Maintain confidentiality of your credentials
  • You are responsible for activity under your account
  • Notify us promptly of unauthorized use

3.2 Acceptable use

You agree not to:

  • Use the Service for illegal purposes
  • Post or share content that violates Meta/Facebook or other platform terms
  • Post harmful, abusive, defamatory, or offensive content through integrations
  • Attempt unauthorized access or disrupt the Service
  • Use automated systems to access the Service without permission

3.3 Social integrations

  • You are responsible for content posted through the Service
  • You must have permission to post to connected pages/profiles
  • You must comply with third-party community standards
  • We are not responsible for content violations on third-party platforms
  • You may revoke access through the third-party platform settings

4. Content and intellectual property

4.1 Your content

  • You retain ownership of content you create
  • You grant us a license to store and process content to provide the Service
  • You warrant you have rights to content you upload or generate

4.2 Generated content

  • BI/AI-generated content is for your use
  • We do not claim ownership of your generated content
  • You are responsible for legal and platform compliance of generated content

4.3 AI-IT INC IP

  • Platform design, code, features, and documentation are property of AI-IT INC
  • Trademarks and logos belong to AI-IT INC or their owners
  • Unauthorized use or distribution is prohibited

5. Third-party services and marketplace partnerships

The Service may integrate with marketplaces, payment processors, POS systems, marketing platforms, social networks, analytics providers, and AI infrastructure. Partner terms apply separately. We may share necessary business data to run integrations as described in our Privacy Policy. We are not responsible for partner outages, pricing, quality, or discontinuation.

6. AI services, BYOK, and data retention

  • Platform AI and optional bring-your-own-key (BYOK) features are available as configured in product settings
  • You are solely responsible for BYOK models, keys, and provider terms
  • AI chat retained by the platform is purged on a 90-day rolling schedule unless law or agreement requires longer retention
  • Analytics and non-essential cookies on marketing properties may load as described in the Privacy Policy

7. Privacy

Use of the Service is also governed by our Privacy Policy. Facebook’s privacy policy applies to Meta features you connect.

8. Limitation of liability

AI-IT INC IS NOT RESPONSIBLE FOR:

  • Content posted to social or marketplace platforms using the Service
  • Violations of third-party terms or community standards
  • Misuse of the Service by users
  • Third-party outages, API changes, or discontinuation
  • Data loss beyond our reasonable control
  • Disputes, fees, or delivery issues with marketplace partners
  • Outputs from customer-chosen AI models or keys

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

9. Indemnification

You agree to indemnify and hold harmless AI-IT INC and its officers, directors, employees, agents, and partners from claims arising from your use of the Service, content you submit, dealings with marketplace partners, violations of these Terms, or violations of third-party terms and applicable law.

10. Termination

  • We may suspend or terminate access at any time
  • You may stop using the Service at any time
  • Upon termination, data may be deleted according to retention practices
  • Third-party integrations can be revoked in those platforms’ settings

11. Changes to Terms

We may modify these Terms at any time by posting an updated version. Continued use after changes constitutes acceptance where permitted by law.

12. Subscription and payment

  • Subscription plans and licensing are billed as described at purchase or in written agreements
  • Fees are generally non-refundable except as required by law or written agreement
  • Marketplace partners may charge separate fees
  • We may change pricing with notice to existing subscribers (typically at least 30 days) applying to the next billing cycle

14. Governing law and disputes

These Terms are governed by the laws applicable to AI-IT INC’s operations in Florida, United States, without regard to conflict-of-law rules that would require another jurisdiction’s law. Disputes will first be addressed through good-faith negotiation, then binding arbitration where permitted, or other legal channels required by law. Disputes with marketplace partners are resolved under those partners’ terms.

15. Entire agreement

These Terms, our Privacy Policy, and any separate written agreements (proposals, SOWs, licenses, or partnership agreements) form the entire agreement regarding the Service. Marketplace partner terms are separate agreements between you and those partners.

By using AI-IT INC websites or the Affiliate-it Platform, you acknowledge that you have read, understood, and agree to these Terms of Service. If you do not agree, discontinue use immediately.
